Terms of service

By signing up you confirm that you are at least 18 years old and either using thinQit for yourself, or are authorised to bind the organisation whose details you provide at sign-up.

If you sign up through your employer or a partner workspace, the relationship between you and that organisation is governed by their internal policies. These Terms apply between you and Thinqit B.V. as the operator of the platform.

We grant you a personal, non-exclusive, non-transferable right to access and use the thinQit service for the duration of your active account. We may update, change, or discontinue features with reasonable notice.

Some features require an active paid plan or available credits. The plan and credit policies in effect for your account live in the workspace billing page.

You agree not to use thinQit to:

• break the law or induce others to break the law;
• generate or distribute illegal content (CSAM, terrorist content, illegal hate speech) or content that infringes someone else's rights;
• attempt to bypass our rate limits, security controls, or AI safety guards;
• scrape, mass-download, or use prompts/outputs to extract or replicate the models of thinQit or our model providers;
• use thinQit to send unsolicited bulk messages, malware, or phishing payloads;
• resell or sub-license the service except under a written reseller / partner agreement.

We may suspend or terminate accounts that violate this AUP, with notice and an opportunity to remedy where the breach is curable.

thinQit's AI agents (Cody, Sophia, Brandon, and others, collectively "Teammates") are tools that produce text, code, images, audio, and actions. They can be wrong. You are responsible for reviewing output before relying on it for production, legal, financial, medical, or safety-critical decisions.

Teammates may be configured to take actions on connected systems (deploy code, send messages, edit documents). Where actions are non-reversible we show approval gates. Any irreversible action you authorise is your responsibility.

Full-version Teammate subscriptions (the standard monthly seat, not Lite or credit-metered variants) include generous usage under this fair use policy instead of per-action credit charges. As a guide, a full Teammate includes roughly 5× the usage that the same monthly fee would buy at our standard credit pricing.

Illustrative example, not a price list: if 10 credits cost €2.50 and produce 1.5 media items, a €750 / month Teammate equals 300 such blocks, or 450 media items at credit pricing. With the 5× fair use allowance that is about 2,250 media items per month. Actual credit prices and per-action costs are those shown in your workspace at the time of use and may change.

Fair use protects the service for everyone. If your usage consistently exceeds the allowance, we will contact you first to agree a suitable plan or top-up. Persistent excess may then be rate-limited. We do not charge for excess usage without telling you. Automated, scripted, or shared-account usage designed to circumvent fair use is a breach of §3.

You retain all rights to the content you bring into thinQit (prompts, documents, files, code). You grant us a limited licence to process that content solely to operate the service for you, secure it, back it up, and make it available to your collaborators.

We do not claim ownership over the outputs your Teammates generate. Generated outputs are yours to use, subject to the model providers' terms (e.g. OpenAI usage policies) and applicable third-party rights.

Keep your credentials safe. Don't share your account. Enable MFA. Tell us at security@thinqit.io if you suspect compromise. You are responsible for activity that happens through your account.

See our Privacy policy for how we handle personal data. We log API and platform activity to operate, secure, and improve thinQit. Logs are access-controlled and retained per the schedule in §7 of the privacy policy.

We target 99% monthly platform availability, excluding planned maintenance, emergency patches, third-party outages, customer-caused issues, force majeure, and AUP-related suspensions. No service credits apply on self-service plans; Enterprise customers receive contractual SLAs in their order form.

You can close your account at any time from settings. We can terminate or suspend an account that violates these Terms, fails to pay, or that we are legally required to suspend. On termination we delete or anonymise account and workspace data per §7 of the privacy policy.

To the extent permitted by Dutch law, thinQit's aggregate liability is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, or special damages, lost profits, and loss of data beyond what our backup obligation requires.

Nothing in these Terms limits liability for fraud, intentional misconduct, or anything else that cannot be limited under Dutch law.

We may update these Terms. We'll notify you of material changes 30 days in advance through the product or by email to the address on your account. Continuing to use thinQit after the effective date means you accept the new version.

These Terms are governed by Dutch law. Disputes go to the competent court of Midden-Nederland (Utrecht), unless mandatory consumer rules give you a different forum.
